Conditions of Sale

1. All goods are sold according to standard specifications which are available on request, and all orders are processed subject to these conditions of sale, unless specifically otherwise agreed to in writing. Any recommendation or advice is offered in good faith but without any liability whatsoever.
2. Delivery of the correct goods in good order and condition will be assumed unless the seller is informed in writing to the contrary within fourteen days of delivery.
3. Ownership of the goods remains vested in the seller until the goods are paid for in full. The risk in the goods will pass to the buyer on delivery.
4. The seller does not accept liability for late delivery or non-delivery due to force majeure or other circumstance beyond the seller's control. No liability for consequential or indirect loss or damage is accepted on the part of the buyer.
5. Payment for goods ordered becomes due thirty days (one month) after the date of the statement on which the goods first appeared. If payment is not made by due date, the seller is entitled to charge interest on the overdue account at the rate of two percent per annum above the prime overdraft rate as quoted by ABSA Bank. Furthermore, all outstanding monies become immediately due and payable. In the event of the buyer's account being handed over to an attorney for collection, all costs of collection will be for the account of the buyer.
6. In the event of the buyer having lodged or in the future lodging any cession, suretyship or guarantee in the favour of any legal entity, the buyer undertakes that the same terms and conditions of such session, suretyship or guarantee shall apply in favour of the seller.
7. The buyer consents to the jurisdiction of the Magistrate's Court in any proceedings which may be instituted by the seller against the buyer, notwithstanding that the amount in issue is beyond the normal jurisdiction of that court.
8. Notwithstanding any relaxation, indulgence or waiver granted to the buyer, no alteration or variation of the contract shall be in force or effect unless it is recorded in writing and agreed to by both parties.
